CONDITIONS DE VENTE
ASTRID GUILLON MAISON DE VENTES est un Opérateur de Ventes Volontaires de meubles aux enchères publiques régi par la loi du 10 juillet 2000. En cette qualité elle agit comme mandataire du vendeur qui contracte avec l’acquéreur. Les rapports entre ASTRID GUILLON Maison de ventes et l’acquéreur sont soumis aux présentes conditions générales d’achat qui pourront être amendées par des avis écrits ou oraux mentionnés au procès-verbal de vente. La vente sera faite au comptant et conduite en euros.
FRAIS DE VENTE
Les acquéreurs paieront en sus des enchères des frais de 19 % HT + TVA soit 22,8 % TTC.
A ces frais s’ajouteront, s’il y a lieu les frais Drouot live : 1.5% HT soit 1,8% TTC frais, pour les enchères gagnantes portées via le live de Drouot.
BIENS PRÉSENTÉS À LA VENTE /GARANTIES
Les attributions faites dans les catalogues de vente ont été établies compte tenu des connaissances scientifiques et artistiques à la date de la vente. L’ordre du catalogue pourra être modifié. Une exposition préalable permettant aux acquéreurs de se rendre compte de l’état des biens mis en vente, il ne sera admis aucune réclamation une fois l’adjudication prononcée. Les indications données par ASTRID GUILLON Maison de ventes sur l’existence d’une restauration, d’un accident ou d’un incident affectant le lot, sont exprimées pour faciliter son inspection par l’acquéreur potentiel et restent soumises à son appréciation personnelle ou à celle de son expert. L’absence d’indication d’une restauration ou d’un accident dans le catalogue, ou verbalement, n’implique nullement qu’un bien soit exempt de tout défaut présent, passé ou réparé étant précisé que les restaurations d’usage et rentoilages sont considérés comme des mesures conservatoires n’entraînant pas de dépréciation. La mention de quelque défaut n’implique pas l’absence de tous autres défauts. Les dimensions sont données à titre indicatif. L’état des cadres n’est pas garanti. Les reproductions aux catalogues des œuvres sont aussi fidèles que possible, une différence de coloris ou de tons est néanmoins possible. Les éventuelles modifications aux conditions de vente ou aux descriptions du catalogue seront annoncées verbalement pendant la vente et notées sur le procès-verbal. Une indication en euros du prix de vente estimé, figure à la suite de chaque lot, ou sur une suite annexée. Le prix d’adjudication résultant des enchères peut varier, bien sûr, en plus ou en moins de cette estimation. Conformément aux dispositions de l’article L 321.7 du code du commerce, l’action en responsabilité de ASTRID GUILLON Maison de ventes se prescrit par cinq ans à compter de la vente aux enchères.
ENCHÈRES
L’adjudicataire sera le plus offrant et dernier enchérisseur, et aura pour obligation de remettre son nom et adresse. Le paiement a lieu au comptant. Aucun lot ne sera remis aux acquéreurs avant acquittement de l’intégralité des sommes dues. En cas de paiement par chèque ou par virement, la délivrance des objets pourra être différée jusqu’à l’encaissement. En cas de contestation au moment des adjudications, c’est-à-dire s’il est établi que deux ou plusieurs enchérisseurs ont simultanément porté une enchère équivalente, soit à haute voix, soit par signe, et réclament en même temps cet objet après le prononcé du mot « adjugé », le commissaire-priseur pourra immédiatement reprendre et poursuivre les enchères. Tout le public présent sera admis à enchérir à nouveau.
ORDRES D’ACHAT ET ENCHÈRES PAR TÉLÉPHONE
Un enchérisseur ne pouvant assister à la vente pourra remplir un formulaire d’ordre d’achat, disponible sur demande. ASTRID GUILLON Maison de ventes agira alors pour son compte selon les instructions contenues dans le formulaire d’ordre d’achat. Astrid Guillon, commissaire-priseur, portera alors les enchères pour le compte du donneur d’ordre, ne dépassant, en aucun cas, le montant maximum indiqué sur l’ordre d’achat, et s’engage à respecter la confidentialité et l’intérêt du donneur d’ordre. Le formulaire d’ordre d’achat ou d’enchères par téléphone doit être reçu au plus tard la veille de la vente accompagné des références bancaires et d’une copie d’une pièce d’identité.
Les enchères par téléphone sont une facilité pouvant être accordée sur demande. ASTRID GUILLON Maison de vente ne pourra être tenu responsable en cas d’erreurs éventuelles, insuccès dû à une défaillance technique, ou non réponse lors de la tentative d’appel. Lorsque deux ordres d’achat sont identiques, la priorité revient au premier ordre reçu. Toute demande d'enchère par téléphone implique offre d'enchère à l'estimation basse du lot.
SUR LE LIVE DE DROUOT
Des frais de + 1,5 % HT des montants adjugés en Live pour les ventes volontaires seront applicables pour les lots acquis via le live. Ce montant sera refacturé à nos acheteurs en live en sus du prix marteau et des frais de vente.
PRÉEMPTION DE L’ÉTAT FRANÇAIS
L’État français dispose d’un droit de préemption des œuvres vendues conformément aux textes en vigueur. L’exercice de ce droit intervient immédiatement après l’adjudication, le représentant de l’État manifestant alors la volonté de ce dernier de se substituer au dernier enchérisseur. La préemption doit être confirmée dans le délai de 15 jours. Dans le cas contraire, l’adjudication sera confirmée pour le compte de l’adjudicataire initial qui devra régler son achat sans délai. ASTRID GUILLON Maison de ventes ne pourra être tenu pour responsable des conditions de la préemption par l’État français.
PAIEMENT
La vente étant conduite en euros, le règlement des objets, ainsi que celui des taxes s’y appliquant, sera effectué en euros. Le paiement doit être effectué immédiatement après la vente. Le retrait des objets peut être différé jusqu’au complet règlement. L’adjudicataire pourra s’acquitter par les moyens suivants :

• Par virement bancaire et en euros.

Les adjudicataires souhaitant régler leurs achats par virement émis d’une banque étrangère devront s’acquitter d’un débours supplémentaire de 20 euros.
• Par chèque bancaire certifié ou chèque en euros émanant d’un établissement bancaire de droit français, domicilié en France avec présentation obligatoire d’une pièce d’identité en cours de validité. En cas de règlement par chèque, seul l’encaissement vaudra règlement.
IMPORTATION / EXPORTATION / LIVRAISON INTRA-COMMUNAUTAIRE
Les lots précédés d’une * font l’objet d’une importation temporaire. Des frais additionnels de 5,5% seront perçus, sauf si l’acquéreur réexporte les biens hors de l’Union Européenne. Les acheteurs souhaitant exporter leurs achats devront le faire savoir au plus tard le jour de la vente. Ils pourront dans certains cas récupérer la TVA sur les honoraires d’achat à la condition qu’un justificatif de douane soit remis à ASTRID GUILLON Maison de ventes dans un délai de 3 mois et que ASTRID GUILLON Maison de ventes soit mentionnée en qualité d’exportateur. Les acheteurs européens assujettis à la TVA peuvent récupérer la TVA sur les honoraires sur présentation des documents requis par les textes de loi. ASTRID GUILLON Maison de ventes se tient à la disposition des acquéreurs pour tout renseignement à ce sujet.
DÉFAUT DE PAIEMENT - REGISTRE DES IMPAYÉS
À défaut de paiement du montant de l’adjudication et des frais, une mise en demeure sera adressée à l’acquéreur par lettre recommandée avec avis de réception. Après cette mise en demeure et à défaut de paiement de la somme due, il sera perçu sur l’acquéreur et pour prise en charge des frais de recouvrement des frais complémentaires de 10 % du prix d’adjudication, avec un minimum de 250 €, ainsi que des intérêts de retard. ASTRID GUILLON se réserve le droit de procéder à toute compensation avec des sommes dues à l’adjudicataire. L’application de cette clause ne fait pas obstacle à l’allocation de dommages-intérêts et aux dépens de la procédure qui serait nécessaire, et ne préjuge pas de l’éventuelle mise en œuvre de la procédure de folle enchère. Les informations recueillies sur les formulaires d’enregistrement sont obligatoires pour participer à la vente puis pour la prise en compte et la gestion de l’adjudication. Vous pouvez connaître et faire rectifier les données vous concernant, ou vous opposer pour motif légitime à leur traitement ultérieur, en adressant une demande écrite accompagnée d’une copie de votre pièce d’identité à l’opérateur de vente par courrier ou par email. ASTRID GUILLON est adhérente au Registre central de prévention des impayés des Commissaires-priseurs auprès duquel les incidents de paiement sont susceptibles d’inscription.
Les droits d’accès, de rectification et d’opposition pour motif légitime sont à exercer par le débiteur concerné auprès du Symev 15 rue Fressinet 75016 Paris.
FOLLE ENCHERE :
A défaut de paiement par l’adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de l’adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai de 2 mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice de dommages-intérêts dus par l’adjudicataire défaillant. Ce dernier sera redevable outre les frais supplémentaires mentionnés ci-dessus de la différence entre le prix d’adjudication initiale et le prix nouveau si ce dernier est inférieur au prix initial, ainsi que les coûts générés par la nouvelle mise aux enchères.
MAGASINAGE - RETRAIT DES ACHATS - ENVOIS Le retrait ou l'envoi des achats doit impérativement être effectué sous 30 jours après la vente, à défaut l'acheteur sera redevable de frais de stockage de 1 € par jour calendaire. Si l’adjudicataire ne dispose pas de transporteur, toute demande d’envoi par la poste ou coursier peut être adressée, accompagnée du bordereau préalablement acquitté, directement. Le règlement du transport est à effectuer directement auprès de ces transporteurs qui se chargent du transport, de l’emballage et le suivi des envois. ASSURANCE :
Dès l’adjudication prononcée, les objets adjugés sont placés sous l’entière responsabilité de l’acheteur. Il lui appartiendra de faire assurer les lots dès l’adjudication. Les biens non retirés seront entreposés aux frais, risques et périls de l’acheteur. ASTRID GUILLON Maison de vente ne sera tenue d’aucune garantie concernant ces dépôts.
Les dispositions des présentes conditions générales de vente sont indépendantes les unes des autres. La nullité de quelque disposition ne saurait entraîner l’inapplicabilité des autres. La loi française seule régit les présentes conditions générales d’achat. Toute contestation relative à leur existence, leur validité, leur opposabilité à tout enchérisseur et acquéreur, et à leur exécution sera tranchée par le tribunal compétent.

CONDITIONS OF SALE
ASTRID GUILLON Maison de vente (ASTRID GUILLON) is a company of voluntary auction sales regulated by the law of July 10th 2000. In such capacity it acts as the agent of the seller who contracts with the buyer. The relationships between ASTRID GUILLON and the buyer are subject to the present Sale Conditions which can be modified by saleroom notices or oral indications given at the time of the sale, which will be recorded in the official sale record.
Purchased lots will have to be paid immediately after the sale. Any buyer bidding online through DROUOTLIVE or any other platform hereby agrees that he/she is fully aware of the possible changes the auctioneer may have orally announced during the sale and consigned in the ‘Proces Verbal’; such buyer cannot oppose having turned off the sound of the computer or not heard such modification. The sale will be conducted in Euros. Purchasers will pay in addition to the hammer price, a buyer’s premium of 19%+VAT i.e. (22,8% VAT included). GOODS FOR AUCTIONS / GUARANTEES The auctioneer is bound by the indications in the catalogue, modified only by announcements made at the time of the sale noted in the legal records thereof. The order of the catalog can be modified. An exhibition prior to the sale permits buyers to establish the conditions of the lots offered for sale and no claims will be accepted after the hammer has fallen. Some differences may appear between the original work and its illustration, there will be no claims in such matter. The measurements are given only as an indication. The statements about any restoration, misshape or harm arisen concerning the lot are only made to facilitate the inspection thereof by the prospective buyer and remain subject to his/her own or to his/her expert’s appreciation. The absence of statements relating to a restoration, mishap or harm, whether made in the catalogue, condition reports, on labels or orally, does not imply that the item is exempt from any current, past or repaired defect. The indication of any defect whatsoever does not imply the absence of any other defects, being specified that basic restorations and relining do not decrease the value of the good since they are considered as conservatory measures. Dimensions are given for guidance only. The state of the frames is not guaranteed. Any changes to the conditions of sale or to the descriptions in the catalogue shall be announced verbally during the sale, and appended to the official sale record (procès-verbal). An estimate in euros of the likely sale price is mentioned in the catalogue, or on a separate sheet, for each lot. This is provided for indication only. The hammer price may of course be above or below this estimate.Pursuant to legal rules, ASTRID GUILLON MAISON DE VENTES is liable for 5 years, starting from the date of the auction sale. BIDS The highest and final bidder is deemed to be the purchaser, and must provide his/her name and address. Payment must be made immediately after the sale. No lot will be transferred to the purchaser before it has been paid for in full. In the event of payment by cheque or bank transfer, property may be withheld until payment has been cleared. Any storage costs that may result are to be paid by the purchaser. In case of dispute after the word « adjugé » has been pronounced, i.e. if two or more bidders simultaneously make the same bid, either vocally or by sign, and claim title to the lot after the word « adjugé » has been pronounced, the said lot can be immediately reoffered for sale by the auctioneer, and all those present may take part in the bidding.
ABSENTEE BIDS Bidders unable to attend the sale must contact the auction house (contact@astridguillon.com Tél. +33 9 83 53 66 85) to send a request for an absentee bid or phone bid. Requests needs to be received by ASTRID GUILLON MAISON DE VENTES at least one day before the sale together with bank references and a copy of the passport. ASTRID GUILLON MAISON DE VENTES will act on behalf of the bidder, in accordance with the instructions contained in the absentee bid form, and try to purchase the lot(s) at the lowest possible price, in no circumstances exceeding the maximum amount stipulated by the bidder. ASTRID GUILLON MAISON DE VENTES will act in the bidder’s best interest and any information concerning the latter will remain confidential. Telephone bidding are services provided for clients. ASTRID GUILLON MAISON DE VENTES declines responsibility for any errors, omissions, technical problem that may occur or if the call has not been answered. Should two written bids be identical, the first one received takes precedence. Any telephone bid implies a bid offer at the lower estimation of the item. On DROUOT LIVE 1,5% will be added on sold lots for voluntary auctions This percent will be re-invoiced to Drouot live’s buyer in addition to buyer’s premium
PREEMPTION OF THE PURCHASED LOTS The State in entitled to use a right of pre-emption on works of art, pursuant to the rules of law in force. The use of this right comes immediately after the after the word «adjugé» has been pronounced, the representative of the French state expressing then the intention of the State to substitute for the last bidder, provided he/she confirms the pre-emption decision within fifteen days. If such confirmation has not been made, the bidder will have to pay his/her item bought without delay. ASTRID GUILLON MAISON DE VENTES will not bear any liability/responsibility for the conditions of the pre-emption by the French State.
PAYMENT The sale shall be conducted in euros. Any payments must be effected in euros. Payment is due immediately after the sale. The payment is made once money has been deposited to
ASTRID GUILLON MAISON DE VENTES‘s account. Payments can be made in the following ways :

Any buyer who wants to execute payment by bank transfer issued from a foreign bank account must pay additional fee of € 20. In cash (Decret June 24, 2015) : up to € 1000 (inc. premium) for French citizens or professionals. up to € 15 000 (inc. premium) for foreign citizens upon presentation of valid passport and evidence of residence abroad.
· By certified cheque or crossed cheque in euros, upon presentation of a valid passport. In case of payment by non certified cheque, the collection of purchase may be postponed until the money has been received on ASTRID GUILLON MAISON DE VENTES’s account.
IMPORTATION / EXPORTATION The items marked with * fall under the scope of the temporary importation rules. Additional fees of 5,5% will apply, unless the buyer exports the goods outside the EU. Such buyers shall inform ASTRID GUILLON MAISON DE VENTES on the day of the sale. They will be entitled, under specific conditions, to deduct the VAT due on the auctioneer’s fees. European buyers who pay VAT can have the VAT deducted on the auctioneers’ fees upon meetings of the legal requirements. ASTRID GUILLON MAISON DE VENTES remains at the disposal of any buyer should the buyer needs information on this matter.
DEFAULT PAYMENT Should the buyer fail to pay the amount due, and after notice to pay has been given by ASTRID GUILLON MAISON DE VENTES to the buyer without success, the buyer will be be charged additional fees of 10% of the hammer price, with a minimum of € 250, together with late payment interest. ASTRID GUILLON MAISON DE VENTES also reserves the right to set off any amount. Such disposition does not exclude compensatory damages and the enforcement of the “procédure de folle enchère” as hereafter described. Should the buyer fail to pay the amount due, and after notice to pay has been given by ASTRID GUILLON MAISON DE VENTES to the buyer without success, at the seller’s request, the lot is re-offered for sale, under the French procedure known as “procédure de folle enchère”. If the seller does not make this request within 2 month from the date of the sale, the sale will be automatically cancelled, without prejudice to any damages owed by the defaulting buyer. In addition to the additional fees above mentioned, the defaulting buyer will be liable for the payment of the difference between the initial hammer price and the price of sale after “procédure de folle enchère” if it is inferior as well as the costs generated by the new auction. The information requested on the absentee bid form are mandatory to have your order proceeded. You can ask for and modify any data relating to you or your can refuse for legitimate purpose in writing to us with a copy of your ID. STORAGE - COLLECTION OF PURCHASES - SHIPPING Lots shall be released upon production of the paid invoice and/ or the lot’s label. Lots can be collected at the auction house upon appointment.
Storage is free during 4 weeks after the auction.
If the buyer has no carrier, any request for shipping by mail will have to be made directly, upon presentation of the invoice paid to THE PACKENGERS who will be in charge of the shipping, the wrapping and the following of such shipping. Payment for the transport must be made directly to the carrier. INSURANCE At the fall of the hammer the title of property shall be transferred to the purchaser, who assumes immediate responsibility for insurance. Uncollected property will be stored at the costs, risks and perils of the purchaser. ASTRID GUILLON MAISON DE VENTES declines liability for lots placed in storage. The clauses of these general conditions of purchase are independent from each other. Should a clause whatsoever be found null and void, the others shall remain valid and applicable. These Conditions of purchase are governed by French law exclusively. Any dispute relating to their existence, their validity and their binding effect on any bidder or buyer shall be submitted to the exclusivejurisdiction of the Courts of France. The French language version of the Sales Conditions prevails on the English version.
